Visa Crunch

PR Australia: New South Wales Has Opened January Registrations For 491 Visa

Australia has reopened its paths for permanent residency again so if you are aiming to get permanent residency in Australia, you might be in luck.

New South Wales (NSW) has now opened the registrations for the Skilled Work Regional (Provisional) visa submission period for January (Subclass 491). Students and skilled employees who meet the eligibility requirements can submit a registration of interest (ROI) until January 31, 2022.

The next round of submissions will open in March. Skilled migrants will be able to live, work, and study in Regional NSW for up to five years under this visa. In addition, they will be permitted to travel to and from Australia as much as they like, and they will have a structured pathway to permanent residency. This visa application can include family members also.

The visa is currently available only through an invite-based system. In order to apply for the stream you should have:

  • A state or territory government agency who is willing to nominate you OR
  • An eligible relative who is willing to sponsor you.

The eligibility, how to be nominated, and the January submission deadline, every required detail can be found in the article. If you are an overseas student in Australia, you are likely to be eligible for the 491 visas under Stream 2.

According to the NSW Government website, to qualify for Stream 2, you must:

  • Hold a valid skills assessment for an occupation on the NSW skilled occupation list;
  • Have completed your studies in the last 24 months;
  • Have studied with an education provider in Regional NSW; and
  • Hold a qualification related to your nominated occupation.

The majority of NSW provinces are in active search of talented engineers, medical professionals, and practitioners due to an acute shortage of trained and skilled workers.  Some provinces are also looking for social workers, cooks, zoologists, carpenters, and human resource managers, among other jobs.

The 491 visa stream has two additional pathways:

  • Stream 1 for people who already live and work in regional NSW, and
  • Stream 3 for people who are skilled in an occupation that is needed in the designated areas.

Each state and territory government agency has its own set of requirements, so you’ll have to read through their own pages to find out what kind of migrants they’re searching for. To register for Regional NSW, you must first:

  • Submit an expression of interest (EOI) through SkillSelect to notify the NSW Government that you want to apply for the 491 visas.

As part of your EOI, you may be required to complete a skills assessment or relevant points exam. This must have been obtained within the three years since your invitation was granted. If your evaluation was for a shorter time period, it should still be active when you complete your EOI and submit it. If you are on a study permit, your qualification must be from a CRICOS-registered program. There are no processing charges for this, and your EOI can be completed totally online.

  • Submit an ROI during a submission window

This submission period will end on the 31st of January 2022. Applicants can express their interest in this visa by filling out this form. Even if you’re skilled in more than one of the listed vocations, you can only register your interest in NSW nomination once during a submission session. If you are not chosen this month, you can always submit a fresh ROI during a subsequent submission session. You must also choose the NSW region you plan to apply to.

  • Be invited to apply
  • Apply to the RDA Office in your preferred region within 14 days of receiving your invitation
  • Provide evidence with your application for all claims in your NSW ROI and SkillSelect EOI.
